STREET PARKING DURING SNOW EMERGENCIES
ORDINANCE NO. 449 Series 2026 - 2027
AN ORDINANCE OF THE CITY OF LYNNVIEW, JEFFERSON COUNTY, KENTUCKY PROHIBITING STREET PARKING DURING SNOW EMERGENCIES.
WHEREAS, City streets are designed to handle vehicular parking without obstruction of roadways, parking during snow emergencies restricts the city from adequately plowing the roadways and they become dangerous to pedestrians and vehicles. This also limits the ability of emergency vehicles to access residential properties when snow has not been removed. As such, parking on the streets during snow emergencies creates a potential safety hazard and liability for the city and results in increased maintenance and repair costs for streets; and
WHEREAS, safe passage and transport is required for all residential properties during snow emergencies; and
WHEREAS, every resident has a right to safely travel on all roadways at any time regardless of all unrelated weather conditions; and
WHEREAS, pedestrians must be afforded equitable means of walking should sidewalks be obstructed by snow or other activities unrelated to weather conditions;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lynnview:
§449.01:.
NO STREET PARKING IS PERMITTED DURING SNOW EMERGENCIES.
449-801. Exceptions. The following are exceptions to this chapter:
(1) Business vehicles that are utilized for deliveries will be allowed to park temporarily during such deliveries as necessary to complete the delivery transaction. Parking is limited to less than 30 minutes. (2) Emergency vehicles (Fire, Police, and EMS) are exempt from this ordinance. (3) Utility Maintenance vehicles (Water, Gas, Electric, Phone, Cable, Plumbing) are restricted to parking only when said vehicles are being used to restore a utility service to a residential or commercial property within the city limits. (4) Designated parking areas are exempt from this ordinance.
§449.02: Any ordinance or parts of ordinances in conflict with this Ordinance or any part of this Ordinance is hereby repealed.
§449.03: Should any section, clause, line, paragraph, or part of this Ordinance be held unconstitutional or invalid for any reason, the same shall not affect the remainder of this Ordinance. §449.98:
This ordinance shall take effect immediately upon its passage and approval and will be published according to Kentucky Regulatory Statutes to all residents of the city of Lynnview.
§449.99: PENALTY.
VIOLATIONS of this ordinance are subject to the following provisions:
- Vehicle is subject to immediate towing.
- The homeowner of the residence where the vehicle is illegally parked shall be fined not less than One-Thousand Dollars ($1,000.00) for the first offense. A subsequent offense will increase the fine to Five-Thousand Dollars ($5,000.00), and each subsequent occurrence will increase the fine by Five-Thousand Dollars ($5,000.00). Each day said offense is committed shall constitute a separate offense.
